Protecting personal data is a priority for Agence de la biomédecine. Rigorous protocols, in line with legal requirements, guarantee their security and confidentiality, while ensuring respect for the rights of the people concerned, in accordance with the General Data Protection Regulation and the French Data Protection Act.

As soon as personal data concerning you has been collected directly by the Agence de la biomédecine in its capacity as data controller (or indirectly by the doctor providing your care) for the exercise of its missions in one of its areas of competence, you have been informed of all the elements concerning this data processing, in accordance with the provisions of the RGPD. We invite you to consult this document.

Certain data concerning you may thus be collected and processed as part of the mission to monitor, evaluate and, where applicable, control medical and biological activities falling within the scope of the Agence de la biomédecine. They may, where appropriate, be combined with data collected by health and old-age insurance funds and health registers (data from the National Health Data System (SNDS), with the authorization of the CNIL.

Some data, in anonymized or pseudonymized form, may also be passed on to research teams, in accordance with the data enhancement charters set up by the agency and in compliance with the provisions of the European General Data Protection Regulation and the French Data Protection Act.

Access to personal data

Throughout their processing, personal data is subject to special protection. In addition to the security measures implemented, the agency ensures that only authorized persons have access to this information (Agence de la biomédecine staff, doctors responsible for patient care, agency service providers involved in implementing the application, and staff responsible for data collection and quality control). The agency takes great care to ensure that the data collected is never misappropriated or used for other purposes.

Protection of personal data

Agence de la biomédecine implements and maintains administrative, legal, technical and physical safeguards to protect personal data against accidental, unlawful or unauthorized destruction, loss, alteration, disclosure, use or unauthorized access. The Agence de la biomédecine takes all precautions appropriate to the nature of the data and the risks presented by its processing, to preserve the security of the data and, in particular, to prevent it from being distorted, damaged or accessed by unauthorized third parties. The mechanisms in place to guarantee the security of personal data are based on an information systems security policy drawn up by the agency, which is strict and compliant with the standards defined by the French government.

Rights of persons concerned by personal data

Any person may obtain communication of information concerning him or her, in accordance with the provisions of the amended Act of January 6, 1978 and the European Regulation of April 27, 2016 on the protection of personal data. You thus have a right to access and rectify your personal data and a right to lodge a complaint with the CNIL. Insofar as the processing of personal data is implemented for the performance of a mission of public interest, and is necessary to comply with a legal obligation, the right to erasure, the right to limitation and the right of opposition provided for by the General Data Protection Regulation do not apply.

In order to protect your privacy and personal data, and to ensure your security, we may take steps to verify your identity before granting you access to your personal data.

These rights may be exercised at any time by sending a request to the recipient center in which you are being cared for and which has indicated the transplant and/or to the Data Protection Officer (DPO) of the Agence de la biomédecine (Délégué à la protection des données, Direction juridique de l'Agence de la biomédecine / 1 avenue du Stade de France, 93212 SAINT DENIS LA PLAINE Cedex or dpo@biomedecine.fr), providing proof of your identity (e.g. identity document with signature). If you do not receive a reply within one month, you may refer the matter to the CNIL.
